To Brokers, Agents, and Buyers RE:  Use of this Website to Bid for HUD Homes:

1.)    No representations or warranties, expressed or implied, are conveyed to the public regarding the condition, suitability for any purpose, compliance with local codes, or value of any HUD home presented for sale on this website. 

2.)    No binding contract of sale exists between a bidder and National Home Management Solution (NHMS) or HUD due to the transmission or posting of any notice to the effect that a potential purchaser's bid has been deemed to be the apparent "winning" offer during any bidding period.  Neither NHMS nor HUD agrees to sell any property based upon an electronic offer alone.

3.)    Receipt of such communication merely serves to notify the real estate licensee for the bidder that the particular offer appears to yield the highest net return to HUD compared to other offers submitted during the same bidding period.

4.)    Until the information that was provided at the time the bid was submitted electronically is verified, and until the time the correct and complete Contract Package (as described on this website) is received, reviewed, accepted on behalf of HUD, executed by an authorized employee of NHMS, and delivered to the purchaser or his/her agent, there is no binding agreement whatsoever, nor is there any promise of one.

5.)    If required or requested documents are not received in proper form within the timeframe provided (normally 48 hours from request), NHMS reserves the right, in its sole discretion, to deem the offer "non-responsive," cancel the bid without notice, award the bid to a back-up or next highest bidder, or re-list the property for subsequent bidding.

6.)    If no acceptable bids are submitted during any given bidding period, NHMS reserves the right, in its sole discretion, to negotiate individually with any bidder or his/her agent, or to continue the bidding process, whichever NHMS decides is more appropriate or in the best interests of HUD.

DO NOT COMMIT FEDERAL FRAUD!  Fraudulent bids subject all parties, including brokers, agents, and buyers, to federal penalties that may include fines and/or imprisonment. A fraudulent bid is any offer made to purchase a HUD property when the intended buyer whose Social Security Number is to be entered on the bidding screen has not been pre-qualified by a mortgage lender; has not properly signed and initialed the Sales Contract and all the required addenda; OR, has not placed on deposit with his/her agent adequate earnest money in the form of a cashier’s check, certified check, or money order to be held on behalf of HUD.
