DEADLINE TO DELIVER DOCUMENTS:   If yours is the winning bid posted on “Bid Results,” you have a 48-hour deadline to deliver the complete and correct HUD-9548 Sales Contract package to NHMS. This must include all addenda, a copy of the earnest money deposit*, and a pre-approval letter from a lender, if any, and/or evidence of cash. Use a delivery service that provides a tracking receipt to keep in your file. Keep a copy of ALL documents sent to the appropriate NHMS office address:

* NOTE : The Earnest Money Deposit (EMD) must be in the form of a Cashier’s Check, Certified Check, or Money Order with no termination date or cancellation provision. Make the earnest money check payable as follows:

  • For New York, New Jersey, and Ohio properties (in the Philadelphia HOC), make the EMD check or money order payable to the Selling Broker’s Escrow Account. (Use the company name, for example: ABC Realty Company Escrow Account.)
  • For Florida properties (in the Atlanta HOC), make the EMD check or money order payable to either 1) the Selling Broker’s Escrow Account, or 2) the HUD Designated Closing Agent (Use the company name for the Closing Agent for your area, for example, XYZ Title Company.)

LEAD BASED PAINT ADDENDUM:
BROKERS PLEASE NOTE: A LEAD BASED PAINT ADDENDUM IS Mandatory for all properties built prior to 1978. Please PRINT THE ADDENDUM from the link supplied in the LISTING of the property and both you as the selling broker and your purchaser(s) then execute where indicated and submit the addendum with your contract package.

Addendum to the Sales Contract
Use the above addendum form to do the following:

Add/Remove a buyer to/from the sales contract – use wording “add (buyers name and ss#) to the sale contract” send addendum and copy of social security card(s)

Correct the the buyers name – use wording “Correct buyers name to (correction) on the sales contract” send addendum and copy of social security card(s)

Change financing – use wording “Change financing to (FHA 203K, 203B, conventional or cash) on the sales contract” send form and letter from the lender requesting the change

Increase the 203B repair escrow – use the wording “Increase the FHA 203B repair escrow to (amount) on the sales contract” send form, letter from the lender requesting this change and a breakdown of the repairs

Change from investor to owner occupant – use wording “Change from investor to owner occupant” - send form
